GTC & conditions of participation

1. General Information
MS Sports AG organises - in cooperation with the "Verein zur Förderung Kids und Sport" - the MS Sports Camps (hereinafter referred to as camps). These GTC apply to the respective camps. The contractual partners are, on the one hand, MS Sports AG - in cooperation with the "Verein zur Förderung Kids und Sport" (hereinafter referred to as VFKS) - and, on the other hand, the participant and the parental authority.
2. Registrations
Registration for the MS Sports and VFKS camps must be made by the legal guardian(s) on schedule. Registration by telephone is also binding. After handing in the registration you will receive a written confirmation as well as an invoice for the transfer of the participation fee (by e-mail).
If the confirmation does not arrive automatically, you are obliged to contact the administration department (in writing to info(at)mssports.ch or by telephone 041 260 33 67). Without a confirmation, there is no right to participate in the camp if the camp is booked out. Every registration received is binding, even if, for some reason, the e-mail confirmation could not be found in the inbox.
3 Participation fees and terms of payment
Participation in the MS Sports / VFKS camps is subject to participation fees, which can be found on the MS Sports AG website and in other documents. The participation fees must always be transferred prior to the start of the camp. If participation fees are not paid in advance, the right to participate expires; the obligation to pay is then ruled by section 4 below. A processing fee of CHF 20.- is due on the second reminder.
4. Cancellations / cancellation with cancellation insurance
Registration is binding. Cancellations will only be accepted in writing (e-mail, post). By taking out the cancellation insurance of CHF 23.-, participants can cancel their registration free of charge. This requires a written cancellation by e-mail to info@mssports.ch, which will also be confirmed in writing by MS Sports. Any camp fees already paid will be reimbursed in full. Cancellations can be made up to 3 days / 72 hours before the start of the camp (usually Friday 09:30) without having to provide any reason.
Cancellations shortly before the start of the camp due to illness, injury or accident must be accompanied by a medical certificate. In this case too, the camp fee will be reimbursed in full. Reimbursement will not be made in the event of misbehaviour on behalf of the participant.
If individual days of the camp are missed due to illness, injury, accident or other plausible reasons, the missed camp day will be reimbursed on a pro rata basis, taking the services already received (e.g. camp dress) into account

If the cancellation is made later than three days / 72 hours before the camp without plausible reason (such as illness, injury or accident), the full camp fee will be charged as normal (e.g. football camp CHF 285.-). By taking out the cancellation insurance, the fee is reduced to CHF 50.- per participant. Rebooking to another camp in the same year is possible free of charge.
If the camp is not cancelled in writing (e.g., if the camp participation is forgotten), the full camp fee will be charged as normal (e.g., football camp CHF 285.-). By taking out the cancellation insurance, the fee is reduced to CHF 100.- per participant.
With the cancellation insurance, additional orders (e.g., a rain jacket for the football camp) can also be cancelled free of charge if the ordered item is no longer needed.
If the camp cannot take place due to official orders, force majeure, pandemics or epidemics, participants with cancellation insurance will be reimbursed the participation fees paid. However, the CHF 23.- for the cancellation insurance is due for payment in any case.
5 Cancellations / Cancellation without cancellation insurance
Registration is binding. Cancellations will only be accepted in writing (e-mail, post). Cancellations up to 30 days before the camp cost CHF 100.-. Later cancellations up to three days / 72 hours before the camp cost CHF 150.-. Cancellations made less than 72 hours before the start of the camp will be charged in full. Unexcused absences will result in the camp fee having to be paid in full. In the event of cancellation due to accident or illness before the start of the camp, we will reimburse the amount paid (minus a processing fee of CHF 30.-) upon a medical certificate. If the camp fee has not been paid yet, a processing fee of CHF 30.- will be charged. Cancellations due to weather conditions or other reasons will not be reimbursed.
If the participant is unable to participate in the camp activities for more than 2 days due to accident or illness during the camp, through no fault of his/her own, he/she is entitled to a partial reimbursement. The fixed costs and the administration fee cannot be reimbursed. In the event of an early return home due to accident or illness (through no fault of the participant), a reimbursement will also be made for absences of more than 2 days.
If individual days of the camp are missed due to illness, injury or accident or other plausible reasons, the missed camp day will be reimbursed on a pro rata basis after deduction of the processing fee and taking services into account that have already been received (e.g., camp dress).

If the camp cannot be held due to official orders, force majeure, pandemics or epidemics, the participation fee will be reimbursed to participants without cancellation insurance up to an amount of CHF 150.-, i.e., an amount of CHF 150.- is also due for payment if the camp is not held, unless the cancellation insurance has been taken out.
In return for the mandatory payment of CHF 150.-, participants without the cancellation insurance will receive a voucher for other MS Sports camps in the amount of CHF 50.- and a service package (e.g., kit) to be freely determined by MS Sports AG and VFKS if the camp is not held due to official orders, force majeure, pandemics or epidemics.
6. Vouchers / Discounts
Vouchers purchased directly from MS Sports AG can be used indefinitely and for all offers organised or invoiced by MS Sports AG. Vouchers are generally not transferable. If a voucher has been won from MS Sports AG or one of its partners, it is only valid for as long as stated and can only be redeemed for the type of sport mentioned.
Discounts can be obtained with a valid discount code. The discount is only granted if it is entered directly in the field provided in the registration process. Discounts are therefore not cumulative. No subsequent discounts will be granted on existing registrations. Discount codes can be used for all offers that are organised or invoiced by MS Sports AG.
7 Liability in the event of accident / illness / property damage
Insurance is the participants responsibility. MS Sports AG and VFKS disclaim any liability for accident, illness or property damage of a participant to the extent permitted by law. In addition, the liability of MS Sports AG and VFKS is limited to the participation fee, as far as damage to the participant was not caused intentionally or through gross negligence on the part of MS Sports AG and VFKS and as far as MS Sports AG and VFKS is responsible for damage caused to a participant solely due to the fault of a service provider.
8. Liability for theft / loss
MS Sports AG and the VFKS are not liable for theft or loss of valuables or cash.
9. Information on the state of health
Registration confirms that the participant is healthy and fully able to cope with sport and can complete the training programme without restrictions. The participant takes part in the training programme on his/her own responsibility. Allergies and any necessary medication must be notified in writing to MS Sports AG and VFKS as well as the camp management prior to the start of the camp.
10. Realisation
The participant must follow the trainer and camp leader’s instructions. If the instructions are not followed repeatedly, the camp management has the right to exclude the participant from the training or the camp. In this case, there is no entitlement to a reimbursement of the participation fee.
11. Camp cancellations
MS Sports AG and VFKS reserve the right to cancel the camp at any time for a full reimbursement of the participation fee.
If the camp cannot take place due to official orders, force majeure, pandemics or epidemics, the regulations in Art. 4 (with cancellation insurance) and Art. 5 (without cancellation insurance) of these GTC apply.
12. Photo/data and film rights
By registering, the participant and the legal guardian agree that pictures and film recordings (data) of the participant may be made and distributed by MS Sports AG, the VFKS and its partners as well as publicly presented (including on the Internet), also for the purpose of self-advertising.
13. Advertising measures
MS Sports AG and VFKS do not pass on any participant data or addresses to third parties. However, we do take the liberty of organising occasional advertising campaigns with our major sponsors to present their products and services. We make sure that the participants' data is only used for appealing and favourable advertising measures. Thanks to the sponsors, it is possible to offer the camps at a reasonable price, which benefits the participants in particular. By registering, you agree that you may be contacted by a sponsor (e.g., CONCORDIA). You are entitled to prohibit MS Sports and the sponsors from using your address data. To do so, send an e-mail with your contact details to info@mssports.ch with the subject "Opting-out-option".
14. Ineffectiveness
Should individual regulations of these GTC not be effective, they shall be replaced by regulations that come as close as possible to the intended economic purpose. The remaining regulations shall remain valid unchanged.
15. Place of jurisdiction
These GTC shall be governed exclusively by the Swiss law. The exclusive place of jurisdiction is Rickenbach (LU).
